उत्तराखंड हाईकोर्ट ने देहरादून के विकासनगर क्षेत्र में शुरू हुई बुलडोजर की कार्रवाई को लेकर दायर विशेष याचिका पर सुनवाई की। मुख्य न्यायाधीश जी नरेंद्र और न्यायमूर्ति आशीष नैथानी की खंडपीठ ने वीडियो कॉन्फ्रेंसिंग के माध्यम से उनके मामले पर सुनवाई की। जिस पर सुनवाई करते हुए कोर्ट ने उन्हें बिना सुनवाई का मौका दिए, प्रशासन के हटाए जाने के आदेश पर रोक लगा दी।
हाईकोर्ट ने राज्य सरकार से कहा है कि सुनवाई का अवसर दिए बिना बस्तियों को तोड़ा जाना न्यायोचित नहीं है क्योंकि सर्वोच्च न्यायलय की गाइडलाइन भी है। उसका अनुपालन करना आवश्यक है। कोर्ट ने राज्य से कहा है कि जिन लोगों द्वारा नदी नालों को पाटा जा रहा। उन्हें चिन्हित के बाद अब तक की गई कार्रवाई की रिपोर्ट 15 अप्रैल तक कोर्ट में पेश करें।
पूर्व में सुनवाई के बाद कोर्ट ने तीन जनहित याचिकाओं में बार बार हुए अतिक्रमण को हटाने के आदेश दिए थे। लेकिन प्रशासन ने उन आदेशों का अनुपालन नहीं किया। बीते 3 अप्रैल को कोर्ट ने सख्त रुख अपनाते हुए सरकार से कहा था कि नदी, नालों और गदेरों में जहां-जहां अतिक्रमण हुआ है, उसे हटाया जाए। उस जगह पर सीसीटीवी कैमरे लगाए जाएं। इनको भी उसी तरह से सीसीटीवी लगाकर मैनेज किया जाए जैसे सड़कों के दुर्घटनाग्रस्त क्षेत्रों को किया जाता है।
कोर्ट ने डीजीपी से कहा था कि वे संबंधित एसएचओ को आदेश जारी करें कि जहां जहां ऐसी घटनाएं होती हैं। उन अतिक्रमणकारियों के खिलाफ मुकदमा दर्ज कर रिपोर्ट पेश करें। कोर्ट ने सचिव शहरी विकास से भी कहा कि वे प्रदेश के नागरिकों में एक संदेश प्रकाशित करें कि नदी, नालों और गदेरों में अतिक्रमण और अवैध खनन ना करे । जिसकी वजह से मॉनसून सीजन में उन्हें किसी तरह की दुर्घटना न हो । इसका व्यापक प्रचार प्रसार करें । 15 अप्रैल तक रिपोर्ट पेश करें ।
